Reject the signed Offer Letter(Enquiry)

Hi,

I would have some question to ask about the title posted above.

I am a fresh man and i have signed an offer letter from company A. After i signed it, there is company B offer me a better job and i decide to take it. I have call to the company A and tell them that i would like to reject they job, the staff ask me to return back the offer letter and talk to the HR manager myself.

My question is

i) will they take any legal actions toward me because i reject the job after i signed the offer letter? is it offer letter same with employment contract?

 ii) do i need to write a resignation letter to them?

 iii) will they blacklist me and spread bad words about me?

 

Really need someone to help me. Thanks for the advice.

 

ps: I am not yet start working in the company and i reject the company one day before i start working.

Since you have told them, that's good enough. No need to do anything from your end.

 I have the same situation, I sign for company A, my serving company counter offer me.  I accept my company counter offer. Then I wrote an email to company A before the working date, say I am sorry that I could not join because my serving company counter offer me.

Company A then counter offer me again I rejected and they say they want to held legal issue on me.

 Hi! I am an employer. We offered a job to an engineer and he accepted our offer. As his resignation notice is 3 months, we waited for him for 3 months. However, 2 days before he suppose to report for duty, he sent an e-mail saying that his current company has counter offered him and he decided not to join us. 

I suppose legally it is not wrong because there is no clause in the offer letter on this matter, however, ethically I feel it is not right. 3 months is not a short period. If he is not 100% into joining us, he should have declined earlier. And now we have to find another person and that would mean another waiting period as that person need to serve his notice period. 

If he informed us in less of one month after he signed our letter, I still can accept, but 3 months is just irresponsible. 

Therefore, Lydia and Wen Hao, I hope you would be more responsible when accepting a job in the future.

Wen Hao. Just ignore that threat. But do heed Hamidah's advice from an employer's point of view.

Hamidah. Just don't give so much leeway next time. They may be just testing the market. Lots of things can happen during that 3 months period.

Hi,

I am having the same issue as Lydia - i signed the offer letter and after a week i emailed the HR to inform her that my company counter offer me and i decided not to leave. I am suppose to start work in 1st September. Will there be able to go for any legal issue on me?

This company is really weird. I applied for AM position and they offer me on the 2nd interview and when the offer letter is ready after a week, it stated the position they offering is Executive and i rejected and it took them 3 weeks to come back to me to say that they can remain the position and when i went and sign the letter . Job title: AM but Job Grade: Executive Level 1 (which is entry level of executive). Working hours : 8.30am - 6.15pm (Mon-Fri) and 1st Saturday of every month (9am - 1pm) - this saturday was not mentioned to me at all during the 1st & 2nd interview till i signed the last offer letter.

My confidence to this company went down the drain and thank god my company counter offer me cos i was really undecided whether should i sign the letter.

Please advice KL Siew wht can they take any legal issue on me.

Hi, KL Siew

I have just signed an letter of appointment with the following term,

Liquidated Damage In the Event of Failure To Report For Work

If after your acceptance of our letter of Appointment, you fali to report for duty as indicated in this letter, without a reasonable and acceptable reason, you shall pay the company, the sum of your monthly basic salary as indicated in this letter of appointment as agreed liquidated damages and not as penalty.

Just in case lastly I decided not to join the company and inform the HR manager 3 weeks before the start date, is it mean that I need to pay the company one month salary?
