Hi,

I would like to understand if the Head Office in Europe had decided to shut down the operation in Malaysia due to poor performance and financially unfit, 

a. Would the employee get the benefits of termination according to the Industrial Act?

b. what would happen if the employee has been offer a job in oversea and the employee disagree with the terms offer in that country? Would the employee be able to obtain the benefits of termination?

Wait for the termination letter and see what are terms or benefits the affected employees will get. If the offers are unfavourable, approach the Industrial Relations Department for help.

If we were offer another job in another country, will the employer require to write the termination letter too?

Where can I download the "layoff benefits" listed in the act?

You can read up the Employment(Termination and Layoff Benefits)Regulations. If there is a job waiting for you, it is up to you to decide whether to go for it or not.
