hello,

what happens if the company decides to reinstate a worker based on the options offered and the worker does not report for duty on date set.  what can the employer do?

You mean the company changed its mind and decided to reinstate the worker after sacking him? What are the options?

Thanks for replying.  Actually the company terminated the worker on grounds of poor work performance.  The worker than lodged a complaint with the Industrial Relations officer who advised us on our options.  1) reinstatement or 2) pay the worker the balance of wages for the remainder of his probation back dated from date of termination.  The company has opted to reinstate the worker,  What happens if the worker rejects the offer or does not report for work as scheduled?  What can the company do?

Would appreciate your advice on this.

You should then get advice from the IR Department as to what to do.
