As stated in the employee handbook; AL is only entitled for confirmed staff (14days ). But after working for 8 months I tendered my resignation, company refuse to compensate my balacne leave on pro rata basis and insisted that Im still under probation. Assuming my salary ismore than 1500,Please advice.

Since you are not covered by the Employment Act, the Labour Department may not have the power to help you. As such, your company's rules may be valid.

 hi, i would like to know the minimum annual leave an employee are entitled is it 8 days ?

how come i interviewed a few job in Batu Pahat, but mostly do not give annual leave on the 1st year working ?

Please advice. Thank you.

Under the Employment Act, the minimum is 8 days. Under the Act, you have to complete 12 months service before entitled to annual leave.

Hi KL Siew,

I need to know according to labour law how to calculate the annual leave for a staff who's already working 5 years plus.It is count from yearly cut off or based on when a staff start joining the company? For example a staff start joining 13rd June 2006 untill today 2011 ,it is count from 13rd June 2006 to 13rd June 2011 or 1st January 2006 to 1st January 2011? Because some company HR said is count on Yearly Cut Off,pleased adviced!

The law is quite clear about it, it is based on every 12 months, but a lot of companies use their own method for convenience to count on yearly basis or because of the annual leave software they use.  Should there be any dispute, the law will have the say.
