I had  to close down my factory because goods manufactured by my key staff were rejected by wholesalers. I suffered heavy losses and unable to pay this key staff last salary before the factory closed, now his is taking me to labour court  for non payment of his  last salary . I had to close down my factory because of his poor performance . Does he has a case against me? I will have to  defend myself in court ....

He surely has a case against you as he was not paid his salary. On top of that, he may also claim termination and layoff benefit from you because of factory closing down. It is now up to you to defend yourself and justify to the Labour Court that you have good reasons not to pay him.

Those products manufactured by him were all rejected and had to return to the factory ,raw material , labour hours , reputation all went  down the drain ,  the factory had to close down because of his mistakes he made, isn't  it a good reason not to pay him ?

Tell the labour court about that when the case comes up for hearing and let the court decide.

 Hi Siew,

I need advice as soon as possible. Today is the 3rd of August, my one year contract ended last months on the 12th and I have already received last months salary in full as I was still working for the company. Today I found out that my contract has already ended and i do not wish to stay. Can I leave immediately since I they have not renewed my contract?

Talk to your employer first. You don't want to just walk away like that.

I am not planing to walk away just like that but instead write a formal letter stating that my contract is ended and i do not wish to continue. Is that ok Ms. Siew?

Yes, you can do that if that is what you want, why not?

Another reason which i can  think of is , during his emplyoment with me  , he was caught teaching other manufacturer to made the same product for a fees , is this another good reason not to pay his last salary? Appreciate your  feedback . Thanks
