Hello,

I have read section 37(1)(c) and the definition for confinement in section 2 of the Employment Act, but the wordings in itself can be quite complex and vague about the actual maximum number of children that she is entitled to maternity allowance.

Is it four or five the maximum number of surviving children that she is entitled to maternity allowance?

(c ) Notwithstanding paragraph (a), a female employee shall not be entitled to any maternity allowance if at the time of her confinement she has five or more surviving children.

I don't think it is confusing. The above says she shall NOT be entitled...if she has five or more....

Excuse my confusion in understanding the clauses clearly. 

Would it be correct then to interpret that a female employee can only claim maternity allowance up to a maximum of FIVE (5) surviving children?

Yes, 5 including the one just born.
