breach of contract

I have joined the Company and signed the employment contract on 1 Jan 2011, it is a 3yrs contract. I have give 1mth notice of termination to the Company on 1 Sep 2011 and going to leave the Company on 30 Sep 2011.

The employment contract stated :

'' If wish to terminate the contract prematurely, shall give the company 1mth notice in writing and compensate the company the sum equivalent to 3mths of last gross salary at the time of termination''.

'' subsidized for professional studies - 50% off from the total course fee and examination fees are to be reimbursed based on subjects passes. But should you breach the contract, the course fee will be chargeable to your last salary.


My question is,

1. Should i compensate to the Company? (Because the salary is only RM1100 after being confirmed)

2. What action can the employer do if didn't compensate.

3. If being sued by the employer, what would be the maximum range of compensation up to?

3. Am i eligible to deduct the examination fee against the compensation (which exam passed within the period of work)?

4.  Is the employer eligible to charge the cost of Company trip which i incurred to my last salary? (the company trip is happened on 19 & 20 Sep 2011 after the notice given, but this trip is organized in Aug'10 and confirmed within the month.)

5. Am i able to pay the compensation in installment basis? because there is no specified date of compensation in the contract.

Since your salary is below RM1500 and you are therefore covered by the Employment Act. As such, the Labour Department may be able to advise you. For me, since you have signed and agreed on some unusual terms, I think it would be better to get official advice by giving them more details.
