Hi.. Our head office in Japan will set skills examination for technical staff and it is a mandatory requirement for them to pass the various level of technical examinations. This is in view of the fast changing business evolution that requires skilled workers in order to stay in the business competitive edge.

Can the employer terminate the services of its employees if they fail the skills test? Bearing in mind, these technical personnel are given sufficient training courses before they sit for such examinations and reasonable time frame and attempts for resit, yet they failed.

The employer will have to go according to the terms and conditions in the contract of service.

This is something set by the organisation in view of the technology advancement in today's busines trends, and the "post examination" requirement was not stated in the T&C of their employment. As they are existing employees, can the employer impose upon them that it is now a mandatory requirement for them to pass the examination, failing which their services with the company be terminated?
