In Akta Kerja, it only stated if a staffs absent one day before or after the public holiday, then the staff is not entitle for such public holiday.

If a staff take unpaid leave which approved by Management before and after off day and public holiday, will they entitle for the paid off day & public holiday?

If according to Malaysia Empoyers Federation (MEF), a staff is  not entitle for paid off day and paid public holiday f they take unpaid leave. So, can it over right the Akta Kerja?

If the company standard of procedure / employment letter did not specific for unpaid leave during off day / public holiday, can the company follow what written in MEF?

Example.

an unpaid leave approved for 17 Nov 2011 - 25 Nov 2011. 19 & 20 Nov  is Off day. 22 Nov is PH. So total un paid leave should be 6 days or 9 days?

As for unpaid leave, which the employees have no right to take, management can treat all rest days in between the period of no pay leave. If you want to avoid that, try not to take no pay leave.
