I have served my notice to my previous company for three month starting 10th Aug 2011. HR sent me email indicated the day for me to offset my annual leave balance 12 days. My official last working should be 09th Nov, however, if I offset my leave in lieu and annual leave with public holiday, my last working day falls on 13th Oct. When, I received my November salary, they only paid me one day. I called HR, they said Idon't have enough annual leave to offset my notice. My entitlement of annual leave only 9 days instead of 12 days due to I worked till 13 Oct only. The calculation of annual leave they advised earlier is upto 09th Nov working. I have received acceptance resignation letter indicated my last day in company shall be on 09th Nov. I felt something is wrong with the calculation. Eventhough, I have not enough annual leave but they don't even pay my rest day. My salary is above RM1.5K. Please advise me what should I do with this?
Everything such as your offsetting of annual leave, last working day etc, should have been sorted out first at the time you submitted your resignation. Now, you can try to seek help from the local Labour Department. With salary above RM1500, I am not sure whether they will be able to help you out or not.
