termination upon acceptance

Hi,

Good day !

Would like to enquire that, due to the frequent turn-down of offer before the new staff can start work but after signing the letter of apppointment,  my company intended to insert the following clause into the letter of appointment :-

TERMINATION UPON ACCEPTANCE

You shall be required to give 1 (one) month’s notice or to pay to the Company 1 (one) month’s salary-in-lieu of notice should you decide to terminate the contract upon acceptance. This shall cover the part where upon acceptance, you decided not to join the Company on or before the commencement date. Should you failed to do so, legal implication shall be applied to you.

Kindly advise can such clause been inserted in the letter of appointment. Many thanks.

You can do that but I am not sure it will really serve any purpose. It is not only costly but it may also discourage candidates from joining the company. Always try to have some reserve candidates to fall back on.

But does it work? If I'm not mistaken this does not really even it stated on the offer letter.
