Annual & Medical Leave Entitlement

Dear Sir/Mdam,

I joined my company 1st January 2012 with 6 months probation. I'm entitled to enjoy 14 days annual &  14 days medical  once i complete my probation.

All my leave which i took during my probation was deducted as unpaid including my medical leaves.

I've been confirmed 1st July 2012. Am i entitle for full 14 days for each medical & annual leaves or it will be pro-rated?

please advise.

If you are covered by the Employment Act, annual leave may be prorated but medical leave should not be prorated. If you are not covered by the EA, you may have to follow the practice of your company.

Thanks alot for your reply.

How do I know whether am I covered under employment act or not ? My monthly Salary is more than 3k.

Also, if I have a staff who is only earning basic salary of RM 1,200. Is this staff also have to go through the 6 months probation without entitle for any leave including the medical leave? or their medical leave should be treated as paid leave ?
