Resignation and Salary on Hold

I have issues with my employer and need some opinion.

  • My HR department hold my January salary and their reason is because I have absent one working day without permission, and they will hold my salary until 7 Feb 2013.(but I have received my payslip for January 2013, only the money is still on hold)
  • I am planning to resign with 24hours notice in February (after I have completed the month of January). But my contract stated that both parties have to give 2 weeks notice to terminate the conract.

My question are, can HR hold my salary for that long and if I decided to resign with 24hours notice, will I get the January salary that they hold on or is there any other results that would happened? Thanks.

If you resign without the required 2 weeks notice, it is possible that the company may deduct two weeks salary from your January pay.
