I have a staff who resigned on 30may2013. She is still on probation thus one week notice should be given for resignHowever she has agreed to compensate a week salary in lieu of short notice. We calculate her last dayWork shall be on 6th June. My question is she still entitled for the 3 days ph on1st to 3rd June (gawai and agong birthday) falls during the notice period is she not working? How Many days she needs to pay us 7 or 4 days ?Pls advice how to calculate this. Thank you.

She should pay 7 days indemnity. Actually she should have opted to work during the notice period when there are holidays in that period.
