Annual leave to offset the notice period

Hi 

If an employee uses his annual leave to offset the notice period in order to bring forward his last day of work, he would only be paid till his last day of work and the annual leave used to offset his leave will not be paid. Is it correct?

He could have applied to clear all his leave before he goes. Did he do that and what did management say?

 The employee gave a month of notice on 13/11/2013 which is until 12/12/2013. After the offset with 5 days of balance of annual leaves, the date has been brought forwarded to 8/12/2013. Does the employee entitle to pay till 12/12/2013 which including the annual leaves or only till 8/12/2013?

The condition is employee would like to release early and the employer suggests the method of offset.

If he agrees with the employer's suggestion then it should be OK.

So, what was the company's suggestion to him in the first, to pay or not to pay? To me, it is only fair to pay up the last day of the notice.

Company hasnt told him whether to be paid. Do you mean last day of the notice is 8/12/2013 or 12/12/2013?
