Annual Leave after tender Resignation

hi,

I would like to tender my resignation letter on this coming 29 Aug 2014 with 2 months notice in GBU Consultant.

My annual leave for this year (2014) is 16 days and last year (2013) balance carried forward leave is 5 days.

May i know which day is my last day to serve my company? How many days Annual leave should I get in this year (2014)?

Please help me to specified the calculation for my total annual leave (year 2013 + year 2014).

Can I use my annual leave to offset the 2 months notice, or if not, can I ask that company "pay" it back in cash?

Am I covered under the Employment Act ? My salary is RM1400.00

Yes, you are covered by the Employment Act.

About leave balance, discuss with your HR what intend to with it. I think you better apply to take all the leave available to you. If they don't approve, they will have to pay for it.

my company is small company..dont have any HR...

that's mean that my 2014 annual leave may calculate like this (16/12)X8 months or (16/12)X10 months include 2 months notice??

Then talk to the boss. Calculate by x 8 months. Why don't you resign on 1 Sept so that August will be a complete month.

my company is 5 working days, 30 Aug is saturday and 1 Sept is public holiday too so i should tender my resignation letter on 29 Aug 2014 with 2 months notice. may i know my last day is on 29 Oct or 28 Oct ( without covered by annual leave)?
