Question on Final payroll

Dear Sirs,

I have question on calculation of final payroll.

Here is the background information:

- Staff joined on 15 Oct 2014

- last day on 13 Aug 2015 (with one month notice to employer)

- however, the staff was not report duty for every working day from 1st to 13th of August, the staff only report duty on 3rd, 5th, 6th and 10th of August.

How's the calculation of the final payroll???

Ask him to pay back salary to the company for the days he did not turn up for work.

If today is 13th August 2015, I have to finish Final payroll to this staff. How to work out the final payment amount?

Basic Salary *13days/31days

Less: Basic Salary *5days/31days (the working days the staff was absent from work 4th, 7th, 12th&13th

= Final payment amount. is it right? do I need to consider annual leave?

Since his last day is 13 August and he did not turn up for work for 4 days, therefore he has only 9 days salary for August. Apart from that, he still has to pay the company 4 days salary as indemnity for 4 days short notice. If he still has leave balance, pay him accordingly.

Under 60E, the staff worked for our company less than 12 months, did the staff entitle annual leave under this regulation?

This is what 60E says:

"and if he has not completed twelve months of continuous service with the same employer during the year in which his contract of service terminates, his entitlement to paid annual leave shall be in direct proportion to the number of completed months of service: "

Does it mean that the minimum entitlement of annual leave be 8 days per calendar year?

If take this as an example

Staff joined on 15 Oct 2014 &  last day on 13 Aug 2015

number of completed months is 9 months??

paid annual leave days = 9months/12 months *8days= 6days??

Dear , 

please advice me, 

my staff join me on 6.04.15 and july was confirmed, tender resign 27th August 15. by mutual understanding she left early from company on 28th august 2015.

we have pay her August salary on 25th August 2015.

Annual leave for a year 21 days. as i calculate ( 21/12 months *4 month her services ) 7.5days 

but she took 9.5 days so she need to pay the company for 2.5days . please advice me as she said its wrong . can i know how is the calculation supposed to be. and what her final salary will be ( her basic RM 3900 + 410 allawonce)
