Overtime Calculation

Just to enquire about Overtime Calculation

-Im working as a personal driver (not executive leval)

-My basic salary on July 2008 was RM1,500.00 and all my overtime calculated based on RM1,500.00.

-In 1st August my basic salary revised to RM1,650.00 not including any allowance or benefit.

-My company said they will calculate my overtime based on RM1,500.00 and not RM1,650.00

-Is it employer have a right to do so?

-Which employment act that I can refer to?

Since you are a personal car driver, I think you are still covered by the Employment Act even though your salary is above RM1500. Thus the OT calculation should base on 1650. Consult the Labour Office.

Can call labour office and get them to consult me over the phone?

if yes can i have a phone number the department that i have to refer?

in the mean time, can i read the labour law act through the internet? do you have the link?

You can telephone the Labour Office. Ask the operator to give you the Labour Office phone number.

Go to this website and look around in the Home Page and look for the Employment Act under item "References"
