Fertility treatment and leaves

Dear all,

I am working in my current company for three years and permanent staff. Unfortunately I have to under go fertility treatment due to my condition. My company doesn't approve my MC from my fertility clinic saying it isn't their panel and deduct from my annual leave or as unpaid leave .

Is it even legal to do it? And since when companies have fertility clinic as panels?

And also since my annual leaves are very less, can they reject my unpaid leaves for my checkup if I'm able to provide supporting documentation from my doctor? As you know, infertility is a medical condition that requires extensive treatment like in my case.

Please advise.

I don't know whether you should have seen the company panel doctor first. If the panel clinic does not have the facility for such treatment, the clinic could then refer you to the specialist clinic for such treatment. Why don't you consult the Labour Department and get an official ruling about your MC, whether it  is valid or not?

i have seen our assigned panel and they don't have any fertility specialist. they only refer to external. which is pretty much the same as we source ourselves.

since their referral clinics are much expensive fertility treatment center while mine is affordable. previously my office rejected my MC from my fertility center saying its not their panel and was on unpaid.

No. Any treatments that involves outside source from their panel clinic, isn't panel. our company panel are normal GP's. not specialist.

my company has the habit of rejecting government MC's also saying its not panel and valid.

The question of what type of medical treatments entitle an employee to MC is debatable. Generally employers would argue that MC is meant for employees who are sick and unfit to work. So going for fertility treatments may not be viewed as MC by many employers.

If your employer does allow you to go on MC for fertility treatments, then you have to seek consultation from their medical panel.

It's best to see the Labour Department for advice.
