Final Payment Release Date

Hi

A) For those employees who are covered under EA 1955, employer has to release the salary not later than 07 on the following month.

1. For those who resigned without notice, it said that employer has to release the payment not later than the 3rd day after the resigned employees' last official day. Does this mean if the last day is on 15th of the month:

- employer has to release the salary latest by 18th of the month, OR

- employer has to release the salary latest by 10th on the following month?

2. For those who resigned with notice, does the above apply?

3. For dismissal case with and without notice, does the above apply?

B) For those employees that are not covered under EA 1955, is employer required to release the salary before 07 on the following month too?

A. salary shall be pay not later than 7th day of any wage period to staffs

1. 18th

​2. Normal resignation, salary shall paid on last employee working day

3. Dismissal normally paid on last employee working day

B. Even you not in EA, salary shall be pay not later than 7th day of any wage period to staffs

If the resigned staff is required to return company properties such as laptop, company phone, keys, uniforms etc, as well as their final timesheet to calculate their last payment, does the employer have the right to hold the salary until all properties and timesheet are received in good condition?

Even though labour law mention need to settle on last day, 3rd day or 7th day, practically industrial not follow tat strictly. 

You can talk to the employee on salary release once company properties are returned

Can the staff then challenge the employer later on the payment being released after the last day, 3rd day and 7th day.

as long you pay them i dun see any need for them to challenge you back. 

They wont getting extra money for that.
