Entitlement to use annual leave under probation for contract staff

Hi, may i know if a contract staff still under probation, does he entitle to use the annual leave?

- Start work in Jun and want to take leave in August, still under 3 months probation period.

- Current salary above RM2,500.

- Contract did not mention annual leave can only use after confirmation and annual leave is 14 days per year.

Since the contract staff's salary is more than RM2000, he does not come under the Employment Act. So, he should go according to terms and conditions stated in the contract about sick leave and other benefits.
