Termination for only working 4 days in a month

Hi there,

I have a staff who's under Contract For Service only started working last month but only worked 40% throughout this whole time, even 2 weeks in a row didnt show up to work without valid reasons. Showcause and warning letter has been issued to him to improve his attendance.

A few days later only after warning letter and discussion, he now repeats the same problem, this has abrupted the operation, so just wondering if :

(1) We can remove him immediately for poor attendance/ insubordination since he is under Contract For Service;

(2) We can issue him Final Warning Letter without notice as he has clearly breached the terms and not listening to our advice just a couple of days ago? then remove him immediately for next convict?

(3) Call in for DI then remove him on the spot if his reasons arent acceptable?

Give a call to the Labour Department and talk to the officer anout it and get an advice.
