OT Calculatuon for Cashier/general worker

Asking for a boy that works nearby my office since he doesn't seem very computer literate. 

He is required to work 12 hours a day but is only paid 2 hours of OT. The employer claims that he is given 2 hours break which is not payable. Is this correct?

Sorry. Should have been clearer. I'd hazard a guess he's in his twenties. 22 or 23 at most. Of legal working age to be sure. He also works at one of those 24 hour marts. So it isn't a small business.

Then it looks OK. Under the Employment Act, rest times are not considered as working hours and OT is not payable for rest hours. However, we really don't know the details. If he has problems with his employment, advise him to bring the matter up with the Labour Department.
