Termination before conformation :bcz of job not successfully

HI..

At our company a staff was never conform to permanent staff.Including november he was working 5 months at this company..at 25 october he was meet an accident..so our company give him medical claim..but we didnt give his bike claim..but he was accident on working hours and he went to putrajaya some office issue..once he come bck he meet that accident..so far he getting better..nw he came to work edy..but our company like to termination that staff bcz some  job never complete..so that our company need to pay his bike claims?then how we need to settle his salary?

Hai there, 

Please be informed that a probationer cannot be terminated during his probationary period except for reason of misconduct.

In this situation, is there any misconduct commited by the employee? if yes, the company need to follows the proper procedure at least by issuing show cause letter to the employee to let him explain.
