Warning Letter

HI Siew,

May I know is there any validity for warning letter issued by a factory?  For example, if the validity is 1 year,  company issues warning letter due to certain misconduct, and there is no same repeated same issue within one year but after 1 year, he or she repeats the same mistakes, shall we issue the 2nd warning letter or it will restart to 1st warning letter? Is it against labor law if we don't practice validity of warning letter? 

another question is 1st and 2nd warning letter must be the same offences? what if we issue 1st and 2nd warning letter with different offences?

There is no hard and fast rule. Warning could be given whenever the misconduct/mistake occurred, irrespective whether it is the same or otherwise. From what I understand, the validity period of such warning is one year, which means the same mistake occurred after one year should not be taken into consideration.

Anyway, you can always consult the Labour Department or the IR Department for official advice.
