Salary deduction & passport keeping of foreign labourers

Hello,

I am asking behalf of contractor who employed foreign workers

Situation 1

Some amount is deducted from the workers’ salary for food, daily necessities and miscellaneous (contractor buys the items for them). No deduction was written on the payslip but the auditors knew it from workers who mentioned it to them.

I suggested that the workers signed a written permission to allow deduction made based on the amount which they owe the contractor.

Situation 2

Auditors was informed that workers’ passport are being kept by contractor.

I suggested that the workers signed a written permission allow safe keeping of their passport by the contractor.

Does the suggestion above suffice? Or the contractor is still required to get approval from the Department of Labour (JTKSM) for the situations above? If so, can you explain the procedures? Such as which office to go to? Processing period?

I couldn’t reach JTKSM by phone and their website seems off

Please advise. Thank you.

Alternatively, you can go there and discuss the matter with the officer there in person.
