Penalty Imposed During Termination

Dear MyLaborLaw,

Recently we have a staff was terminated during his probation due to serious misconduct (we have issued him a warning letter). In his letter of appointment, it is clearly stated the staff needs to pay penalty to replace the training cost which we have provided for him. In the event that if he reluctant to pay, can we forward this case to Industrial Relation Dept or Labour Dept?

You better consult the Labour Department or iR department about it. But I think they may not  take action in such a case.

Additionally, what kind of serious misconduct? And have you followed due process?
