I have given my resignation letter to my employer for 1 month notice but he has rejected it. If they still dont want to receive it, can i still leave according to my resignation letter with 1 month notice? I means that if my resignation letter is dated 25 March 2009 and can I still leave on 25 April 2009 if they don't want to accept my letter?
If they hold my pay for the last working month due to I leave on time, what can I do?
Make sure he receives your letter, you don't want him turning around to say you left without notice. Give a copy to your HR also or send the letter by courier service. If he does not pay you, you can complain to the Labour Department.
My colleague has tendered his resignation letter on 18 March 2009.He need to serve 2 month notice to resign. As such, the last day to work is 15 May 2009. He has 20 days of Annual Leave. He plan to use it and set off against the notice period as he needs to leave the company urgently. His salary is above RM1,500.
My question is :-
1. Can he request company to use his leave to set off the notice period?
2. Can HR management reject his request of item (1)?is it up to the discretion of them? They will pay him the 20 days of leaves if he stay until 15 May 2009.
