Employment Agreement

We have a staf who joined us in April 07, we only just gave him his Employment agreement to sign . He however now refuses to sign his agreement citing his leave should be under the Executive category whereby it is 15 days & not 14. His position is the HR and Admin Executive, which falls under the Non-executive level.

Since his performance in HR matters do not impress my Management , they rather he just leave, Can we dismiss him if he doesnt want to sign his EA?

If you think that is a serious misconduct that warrants dismissal, you have to hold a domestic inquiry and give him a fair hearing before you do that. Try to approach the Industrial Relations Department and get their opinions. I really don't understand why the appointment letter was not given to him before he reported for work. Had you done that the misunderstanding should not have happened.
