Short Notice Payback Calculation

Hi,

I'm required to give 3 months notice but I only manage to give 2 months notice.  Noted that I'll be required to payback 1 month salary in lieu.  Just need to confirm will the payback be my gross salary or based on my nett salary after deducting EPF and Tax.  If it is gross salary then will the company pay for my EPF and can I exclude this in my income tax deductions? Note that my salary is above RM1,500.  Also my management have approved me to leave earlier than 2 months as I still have balance earn annual leave of 6 days.

In my opinion, you have to pay back a full month's salary, 5000 salary you pay back 5000, 10000 you pay 10000. Consult EPF and Income Tax Dept if you think necessary.
