  1. OT of RM120 (all-in incld mileage, toll, etc) will be paid for those working on roster off days, rest days (or on public holiday even if its a rest day/ph)
  2. Working is 12hours / shift.
  3. Those working on a PH will be paid OT of lump sum of RM120.00 (12hours work).

a. Staff who roster to work on a Public Holiday cannot choose to take the Public holiday as their day off, as they are roster to report for work.

b. If they choose to take the Public holiday as an off day then the day will be considered as an Annual Leave and a day will be deducted from their yearly annual leave records.

c. Those who are schedule for off days on a Public Holiday will not get in lieu replacement for a Public Holiday.

My worry is part 3. Please comment further. For info salary is more then 2k, its a 12hrs shift work & there is a fixed monthly standby allowance.

Although you are not covered by the Employment Act, but by the Employment Act standard, the deal is not that attractive and I think you know why. Negotiate for a better deal if possible.

Hi, I have a problem related to employees' overtime. Instead of making overtime payment to the staff, can the company request the staff to claim hours. Meaning like, if a staff worked 4 hours overtime, he can leave his work place 4 hours earlier. Is this violation of the employment act? Shall the company ask the staff to sign any agreement on such arrangement.

Thanks and need advise.

Under the EA, overtime work must be paid and there is no provision for replacing it with earlier off duty.
