婴儿生存当然可以拿，少过28星期流产夭折就不能享有生育金。

请问这28星期是否有注明在劳工法里？ 因为我反复读了几遍都没看到...

以下我的解释是否正确？

是否只要产妇把孩子顺利的生下， 就能享有产假与津贴？

而不幸流产或是在生产时孩子不幸夭折，就不能享有产假与津贴.

而重点是在于孩子是否生存而不是，怀孕周期， 对不对？

我会问这个问题是因为我看到我公司之前的人事部小姐所写的policy的一下内容；

-          If a female employee gives birth to a child or children before twenty-eight (28) weeks of pregnancy, she will not be entitled to Maternity Leave whether the child survives or not. The leave taken will be treated as Sick Leave.

不知道这是是否已经违规了呢？

It is under "confinement" in Section 2 of the Employment Act.

I am not sure whether that "policy" is entirely correct or not. When there is a birth certificate that the baby is alive, I would say maternity allowance is payable. it does not matter whether the baby was premature or not. I think how many week of pregnancy is normally not mentioned in the birth certificate, only mentioned in the death certificate when it was a still birth. 

Check with the Labour Department about this also.

 I'm sorry that I have another question about the maternity allowance. Can they get the pay end of each month or they get the pay when they come back to work?
