&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; I am a worker in one of the larger MNC company, i did a mistake &amp; i already signed the 1st written warning letter(all the benefic already deducted by the company), but after three month the HR-ER department want to reopen the case &amp; make another punishment&nbsp;to me. In this three month period i no have any new case inlvove me.

I had worked in the multinational company for approx 8 months ago as i did not receive any confirmation letter yet from my management.As i refer back my appoinment letter stated that&nbsp;probation period&nbsp;are 3 months only.As for my concern,I did&nbsp;inform&nbsp;my management about my probation period has been expired on last year Dec 2011.As my management&nbsp;replied me that our HQ in US&nbsp;been&nbsp;KIV my confirmation,till today i do not receive any warning letter nor extend probation period even no email at all.Eventhough i did ask again what was actual behind the reason at least i can improve myself,however there are no reply at all.No training been provided during my last probation period.

您好！我想请问有关于加班费。劳工法令里面有没有限制薪金要超过RM 1500，公司有权利不给加班费吗？我公司现要聘请员工，工资1天RM 50，也就是说一个月大概RM 1300。我公司不打算给加班费。 请问这有违反劳工法令吗？如没有，在appointment letter我们是不是一定要写清楚这个加班费呢？

An employee had tendered a resignation letter dated 30th Sep and given 18 days of notice to the former employer (a bank). Before tendering the resignation letter, the employee had checked through the HR system and noticed that the remaining annual leave was left 9 days. So total all together that would be 27 days of notice, however, the employee is suppose to give 1 month (30 days) prior notice to the bank. The employee understood the bank process that the bank might hold or to calculate the final payment to the employee and that might take up to 1 month. The employee last working day was on 17th&nbsp;of Oct, and expected to receive the final payment on somewhere in November. Basically, a bank will pay the salary on time (every 25&nbsp;th of the month) with accurate amount. On 25th&nbsp;of Oct, the employee received his salary in 1 full month payment, and the employee thought that the bank maybe had waived the difference of 3 days and paid the employee in full month salary. Everything goes fine until the following month (25th&nbsp;Nov), the employee received additional of 1 month salary in the bank account. Days later, the employee received a call from his former branch manager, and asked &ldquo;on when you had tendered your resignation letter?&rdquo; The employee was shocked when heard of this question, and the employee had mentioned the truth regarding the date of resignation and duration of period given to the former branch manager. On 16th&nbsp;of Dec, the employee received a letter from the bank regarding the acceptance of resignation and mentioned that the actual balance of annual leave was only 4 days, and given 12 days short of the required notice, of which the employee are liable to pay in lieu. On 11th&nbsp;of Jan, second letter from the bank had delivered to the employee and asked the employee to pay back 2 months&rsquo; salary to the bank within 14 days. Moreover, both letters were wrongly addressed the employee&rsquo;s title as MS instead of MR. The employee had attached both letters from the bank for reference at below. Understand that according to the Malaysia Employment Act of 1955, under clause 24.2, it shall be lawful for the employer to make the deduction of wages. But there are a few queries would like to ask as below;

他说他有权利这样决定。？？

1) I work 5 and half days per week, and Sunday is my normal working day, 01-01-2012 is Sunday and Public Holiday while 02-01-2012(Monday) is a Public Holiday Replacement set by Government which that day also my weekly off day, Do i get a replacement holiday because of it?
2)05-01-2012 is a normal working day for me but due to sudden flood i could not go to work. Can i using my off day to replace that day instead of taking a leave for it?

He met with an accident on 17 Dec&nbsp; (Saturday) and broke his hand. He didn't go to see the doctor immediately. He only went to see the doctor on 20 Dec (Tuesday). He has not&nbsp;been hospitalized but he has been on MC ever since. He submitted MC from Hospital Universiti Malaya. He has been given MC from 21 Dec until 10 Jan 2012. Which means that he was on MC for 8 days in Dec. He didn't come to work on 11 Jan 2012. On 13 Jan he texted saying he's going for his check up and extending his MC. Do we have to pay him for his MC and how can we terminate him? He is still under probation and performance has been unsatisfactory.</p>]]></description>

I need to find out, 1 of our staff is resign and he give 1 month notice &amp; his last date is 22/8/11. Then on 8/8/11 till 12/8/11 he take 5 days annual leave. May&nbsp;l know how to calculate his salary? His still got&nbsp;8 days annual leave that our company will encash to him. His basic salary RM1650 and attendance allowance RM100. we know that annual leave encash calculation is basic salary/26 but how about the 5 days annual leave he take on 8/8/11 till 12/8/11 which also divide 26 days? because this 5 days is&nbsp;within resignation notice so l think this is divide by 31 days not 26 days,&nbsp;right? and the balance 8 days is divide by 26. one more thing, if the allowance is for attendance not a fixed allowance, for annual leave encashment also need to add it? Eg: basic 1650 + attend.all. 100
Please advice the calculation.

We called the hospital but he was not warded nor was he treated as an outpatient at the ER. Liars aside, we don't want him anymore. Can we inform him that based on the circumstances, our offer letter is deemed null and void? Or must we issue a termination letter? If it's termination of employment, can we cite his current physical condition (due to the &quot;accident&quot;) deems him unfit to perform his duties properly (and his recuperation period will be long and we need someone to fill his position ASAP), as a reason for termination? Or should we just state his misconduct/poor behaviour in lying to us about the accident, as a reason?
